Terms of Service

These Terms of Service ("Terms") set forth the conditions for using the services (the "Service") provided by AREA35, inc. (the "Company") through its online store "AREA35 OFFICIAL STORE" (the "Shop"). By using the Service, customers ("Users") are deemed to have agreed to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between Users and the Company regarding the use of the Service.
  2. The Company may establish additional rules such as the Shipping Policy and Refund Policy (collectively, "Individual Rules"). Regardless of their names, Individual Rules constitute a part of these Terms.

Article 2 (Formation of Sales Contract)

  1. A sales contract is formed when the Company sends a shipping confirmation email in response to the User's purchase order.
  2. Notwithstanding the preceding paragraph, the Company may cancel or rescind a sales contract in the event of a violation of these Terms, fraudulent conduct, out-of-stock items, pricing or listing errors, or other similar circumstances.

Article 3 (Prices and Payment)

  1. Product prices, shipping fees, and other charges are as displayed on each product page and the order confirmation screen.
  2. Users shall pay via the payment methods designated by the Company.
  3. Product prices may change without notice due to fluctuations in foreign exchange rates or other factors.

Article 4 (Delivery and Transfer of Ownership)

  1. The Company will deliver products to the address designated by the User after the sales contract is formed. Delays may occur due to weather, customs, carrier conditions, or other factors.
  2. Ownership of and risk in the products transfer from the Company to the User when the carrier delivers the products to the User.
  3. Import duties, VAT/GST, and customs handling fees for international deliveries are not included in the product price or shipping fee and shall be borne by the User as the recipient. Details are set forth in the Shipping Policy.

Article 5 (Returns, Exchanges, and Cancellations)

  1. The conditions and procedures for returns, exchanges, and cancellations shall be governed by the Company's Refund Policy.
  2. If a delivered product is defective, damaged, or incorrect, please contact the Company within 10 days of delivery. The Company will bear the return shipping cost in such cases.

Article 6 (Intellectual Property)

All content on the Service and the Shop (images, logos, text, character designs, etc.) is the intellectual property of the Company or its rightful owners. Users may not reproduce, repost, or commercially use such content without permission.

Article 7 (Prohibited Conduct)

Users shall not engage in the following conduct:

  1. Conduct that violates laws or public order and morals;
  2. Payment through fraudulent means (e.g., unauthorized use of another person's credit card);
  3. Purchasing for the purpose of resale or profit;
  4. Conduct that destroys or interferes with the Company's servers or network functions;
  5. Any other conduct deemed inappropriate by the Company.

Article 8 (Disclaimer)

  1. The Company does not warrant, expressly or impliedly, that the Service is free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security; errors or bugs; or infringement of rights).
  2. Except where attributable to the Company, the Company shall not be liable for any damage incurred by Users arising from the Service.
  3. Nothing in these Terms limits any consumer rights under mandatory laws applicable in the User's country of residence.

Article 9 (Amendments)

The Company may amend these Terms when it deems necessary. Material changes will be announced by posting on the Shop or by other appropriate means, and the amended Terms will take effect on the effective date specified at the time of posting.

Article 10 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
